Brisbane Birth Photography | Terms and Conditions

Brisbane Birth Photography aim to make our client experience the best possible. We are a small family business with one primary aim – to create a  beautiful experience for and make beautiful memories of your family. This means that when you engage us, you agree to abide by all business practices and standard operating procedures including the following Terms and Conditions of engagement:
  1.  Package inclusions and specifications are determined by management and subject to change as required.
  2.  Packages and prices also are subject to change as required by Brisbane Birth Photography.
  3.  Clients must pay a non-refundable retainer fee in order to secure their booking.
  4.  Brisbane Birth Photography own full copyright of all images and digital content produced by photographers and staff working on behalf of the business.
  5.  All payments must be made according to our agreed payment schedule. Management reserves the right to cancel or not attend a shoot if scheduled payments have not been made by their due date.
  6. Where flexible payment options are set up (such as payment plans), regular repayments of weekly, fortnightly or monthly (at a minimum) repayments must be made.
  7.  Cancellation of birth photography services will attract a cancellation fee. For cancellations before 20 weeks, clients forfeit their retainer. For cancellations after 20 weeks, a $500 fee will apply. For cancellations after 30 weeks, a $1000 fee will apply. For cancellations after 35 weeks, a $1500 fee will apply. These cancellation fees are in addition to the retainer, not inclusive of.
  8. Brisbane Birth Photography cannot guarantee to produce any photo specifically requested by the client.
  9. Clients accept that the spontaneous and unpredictable nature of birth means that the extent of coverage and images produced during a birth will be dictated by the events of the day and how things proceed. As a result, there is no guarantee that we will be able to produce everything that our clients want during a birth.
  10. Brisbane Birth Photography must work with medical facilities and staff in a way that is respectful and supportive.
  11. For portrait shoots (e.g. maternity, newborn, family), a no show fee of $200 will be charged. This is not able to be used as credit towards a future session or products.
  12.  All significant parties (e.g. both parents, all adults) are required to attend the pre-birth consultation and viewing/purchasing appointments.
  13. Clients irrevocably and perpetually consent to Brisbane Birth Photography and its photographers/videographers using any and all images and digital content from their session(s) for public relations, general marketing, advertising/promotional use, editorial/media, educational and industry use (e.g. industry competitions). No payment, discounts, refunds or compensation will be granted to clients for such uses.
  14.  Client accept that a backup photographer may need to be sent to a birth in instances where primary photographer Selena Rollason is unable to attend. It must be accepted that a variation of style, content and quality may be experienced due to the subjective and interpretive nature of photography and photographer experience.
  15. Any special sessions or alteration to prices and packages that are outside of our standard services (such as discounts, special offers, model/portfolio building shoots) are provided at the discretion of Brisbane Birth Photography and terms and conditions may apply.
  16. Brisbane Birth Photography reserves the right to refuse service at anytime.
  17. Special offers and gift vouchers cannot be used towards orders already booked or to purchase portraits and products from a previous photography session.
  18. Weekend sessions and appointments may attract a $150 outside-of-hours fee.
  19. All purchased images will be backed up and stored for up to 7 years. Unpurchased images will be removed 12 months after your shoot date.
  20. Orders must be paid and finalised no later than 12 months after your shoot. After 12 months, Brisbane Birth Photography reserve the right to cancel an order or complete and deliver a client order without any refunds or further input.
  21. No products will be finalised or printed until full payment has been received.
  22. Any offers may not be used in conjunction with any other offer or voucher and is not redeemable for cash or any other goods and may only be used as described. Offer not transferable.
  23. Images are edited and produced in accordance with industry and Brisbane Birth Photography standard practice and procedures (as seen on our website). Additional work or specific editing requests outside of standard practice will attract a $50 per image charge.
